Legal tips: how to help an incarcerated friend or family member
If you have a friend or a family member that is incarcerated, you need to do a few things to help them out. When they?re in there you?re the only person that can help them. If you leave them without your assistance, they may end up staying in there for a long time without the resources that they need. They will only get very little foods and other resources.
When a person is incarcerated they need to be bail out or they need a good lawyer. It all depends on whether their case is serious or not. You don?t need to bail them out. This is only if you can afford to or if they request that you bail them out if they have the money to pay for themselves. Wealthy people get arrested too. They can be in there for a DUI, or driving with a suspended driver?s license. People have all sorts of reasons why they?re incarcerated.
The bail amount is usually set according to the seriousness of the crime. Some crime bail is set at $ 200,000 and you have to put it on your house too. You can pay like 20% of the bail and put the rest on the house that you?re living in. I don?t think that bail is necessary unless the incarcerated person has the funding or is a public figure and they don?t want to stay in jail. The common citizen can?t afford bail this much anyway. If bail is too high, you can just leave the person in jail because even if they?re bail out, they will still have to go to trial later and may be convicted and have to serve time. The most important thing is that if you leave them in jail, the time they serve will be credited at the time of their hearing and they may even be set free because they?ve already served their times. If you bail them out then they will have to come back to jail and serve for a year or two if they?re convicted. The best thing is to leave them in jail.
The next part is deciding to get them a lawyer or not. This will depends on how serious the case is. If the case is minor like dui, petty theft, driving with a suspended driver?s license, then you can leave it to the public defender to help out the incarcerated person. A public defender is a lawyer that works for the court to help out those that can?t afford their own lawyer. Public defender can take care of small cases very well. It can be a waste of money if you hire a lawyer for a small case because they will get you the same result that a public defender will get you.
If you pay the bail amount then the incarcerated person can be released after paper works are done. A public defender can work this case just fine. You will want a lawyer if the case?s penalty is life in prison or 2-more years in prison. A private lawyer would take care of this matter more effectively then a public defender. A public defender will not be able to dedicate all of their time and energy to this case because they also have 10 other cases. If you leave a case like this to a public defender, the incarcerated person may go to jail for the maximum numbers of years. There are people that can?t afford a private lawyer and they have to stick with a public defender.
There are things that you should do and should not do to help the incarcerated person. For example, you should not make statements against that person to authority because it can hurt that person. Everything that you say or write down will be record by authority therefore; it?s best that you don?t make a comment and leave everything to a lawyer to take care of. The more you say the more harm you can do the incarcerated person. If you must make a statement, it should only be positive statements or reasons that can help the incarcerated person out. For example, you can say that the person has a mental illness or a medical condition and that can help authority know what to do to the person. Medical reasons will help an incarcerated person a lot because their charges can be reduce or cancel if they?re mentally ill like being insane or have other health problems.
Medically ill people will be at the hospital jail in a room by themselves instead being in the same room with hundreds of other people. If the incarcerated person is medically ill you need to let the jail know as soon as possible because it can save the person?s out of everything that they?ll be subjected to. Again, you should never make a negative statement because it?ll be recorded down by authority and it could hurt the incarcerated person.
For example, if you said that your friend was driving drunk because you were partying with him, then you just made a statement that could be use to convict him because you?re the witness. Therefore, you should not make any statement unless it?s a positive one.
If you have a really serious case and you want to hire a private lawyer for your case, you need to be aware that lawyers do charge very high for each case that they take. Therefore, you have to have the funding before you can go to a lawyer. If for some reason, you don?t have any funding, then you should leave the incarcerated person with a public defender. If you do have funding then you should hire a private lawyer. Even if you do have a lawyer, court cases will drag from months to years and your friend or family will still be in jail serving those time unless they?re bailed out. The process is a very long one; therefore, you should teach your children to stay away from trouble so that you don?t have to lose money and time for their trouble.
